How Much Compensation Can You Recover in New Jersey?

New Jersey does not cap compensatory damages in personal injury cases, which means there is no statutory limit on what you can recover for medical expenses, lost income, and pain and suffering. The value of your claim depends on several factors, including the severity of your injuries, the extent of your financial losses, and the degree of the other party's negligence.

Recoverable economic and non-economic damages in a New Jersey personal injury case typically include:

  • Current and future medical expenses

  • Lost wages and diminished earning capacity

  • Physical pain and emotional suffering

  • Loss of enjoyment of life and quality of life

  • Impairment and disfigurement

  • Out-of-pocket expenses

  • Property damage

New Jersey follows a modified comparative negligence standard, which means you are not automatically barred from recovering damages if you share partial fault for the accident. If your fault is 50% or less, your damages are reduced by your percentage of fault. However, if your fault exceeds 50 percent, you recover nothing. For example, if you are found 20% at fault on a $100,000 claim, you would receive $80,000. On the other hand, if you were found 55% to blame, you would receive nothing.

How Long Do You Have to File a Personal Injury Claim?

Under New Jersey law, you generally have two years from the date of injury to file a personal injury lawsuit. Missing this deadline almost always results in the court dismissing your case, which is why consulting an attorney promptly after an accident is critical.

There are limited exceptions that may extend or shorten this window. If you did not discover your injury right away, the discovery rule may adjust the start date of the filing period. Claims against New Jersey government entities require you to file a tort claims notice within 90 days of the incident to protect your right to sue. Minors generally have until their 20th birthday to file a claim.

Because the factors in your could result in a different deadline or other requirements, it is best to seek legal advice as soon as possible.

What Should You Do After an Injury?

The steps you take immediately after an accident can significantly affect the outcome of your personal injury claim. Taking the right actions early helps preserve evidence and puts you in a stronger position to recover compensation.

  • Seek medical attention, even if your injuries seem minor

  • Document the scene with photos and collect witness contact information

  • Report the incident to the appropriate authorities

  • Keep records of all medical treatment, prescriptions, and expenses

  • Avoid giving recorded statements to insurance companies before speaking with an attorney

Insurance companies often move quickly to settle claims for less than they are worth. Having an experienced attorney on your side from the start levels the playing field and protects your right to full compensation.

Frequently Asked Questions About Personal Injury Claims in New Jersey

How does New Jersey's no-fault insurance affect my personal injury claim?

New Jersey uses a no-fault auto insurance system, which means your own insurance covers initial medical expenses through Personal Injury Protection regardless of who caused the accident. New Jersey drivers must choose one of two insurance options: a 'limitation on lawsuit' (verbal threshold) policy with lower premiums, or a 'no limitation on lawsuit' (zero threshold) policy with higher premiums.

If you chose the limitation on lawsuit option, you may only sue for pain and suffering if your injuries meet the state's serious injury threshold under N.J.S.A. 39:6A-8, which includes death, dismemberment, significant disfigurement or significant scarring, displaced fractures, loss of a fetus, or a permanent injury. If you chose the no-limitation option, you may sue for pain and suffering regardless of injury severity.

What if I am partially at fault for my accident?

New Jersey's modified comparative negligence rule allows you to recover compensation as long as you are 50% or less at fault. Your total award is reduced by your share of responsibility. If a jury finds you 25% at fault for a $200,000 claim, you would receive $150,000. If your fault exceeds 50%, you cannot recover any damages.

How much does it cost to hire a personal injury lawyer?

Most personal injury attorneys, including The Cassidy Law Firm, work on a contingency fee basis. You pay no upfront legal fees, and your attorney's fee comes from a percentage of the settlement or verdict recovered on your behalf. If there is no recovery, you owe no attorney fees. We offer free initial consultations to evaluate your case.
